Prosecutors have dropped three of the five charges against Kodak Black following his January 18 arrest, but the often-incarcerated rapper found himself facing two additional charges on Thursday (February 22), according to the Sun Sentinel.

The prosecution added charges of felony possession of cannabis and possession of ammunition by a delinquent. They dropped the charges of possession of a weapon by a convicted felon, third-degree grand theft and child neglect.

Black, whose real name is Dieuson Octave, was originally arrested after he posted an Instagram Live video that showed party guests smoking marijuana around his infant son. Another guest was allegedly brandishing a pistol near the child. Black, who has been on probation since August 2016, isn’t allowed to have drugs or guns in his possession.

His attorney, Bradford Cohen, was successful in filing a motion to dismiss some of the charges, arguing the video didn’t show his client holding the weapon. But he still has an uphill battle with the new charges added to Black’s case.

“It was the right decision for them to make,” Cohen told the Sun Sentinel. “Clearly there’s still more work to do, but I’m glad the State Attorney’s Office considered the information I sent them and the arguments I was preparing to make to drop those charges.”
